MESSAGE

Dear Comrades,

          I alongwith the National President Sh. Ashim Pramanik and Secretary General Sh. Shankar Kumar Saha had been in Delhi during the last week.  We took stalk of the status of various issues and pursued them at the concerned levels of CBEC.  The issues are as under:

1.    Much delayed promotion to Chief Accounts Officer (CAO).

2.    One Time Relaxation for promotion to Administrative Officer, Inspector & Senior Tax Assistant.

3.    Promotion against newly created posts on the basis of the existing Recruitment Rules.

4.    Counting of the length of service of Sepoy as qualifying service in the post of Havaldar for the purpose of promotion of LDC to the post of TA.

5.    Notification of the Recruitment Rules of Executive Assistant (EA) at variance with that of CBDT.

6.    Recruitment Rules and Seniority List of Administrative Officer.

7.    Revision of Pay and assignment of up-graded Pay structure in the wake of implementation of 7^th Pay Commission.

The developments on certain issues were positive, whereas, on certain other issues it was not so bright.  We followed up everything and met the Senior Officers to expedite them.  Details are being placed in our subsequent message.

On organizational front we decided to firm up our ties with CoC.  Though we could not take part in the CoC meeting held on 28.03.2016 for an unavoidable reasons, our President was in constant touch with the CoC leadership.  It was felt that issues relating to up-gradation of Pay can be better pursued from a bigger platform like CoC [A Committee consisting all Association of CBEC and CBDT] (Minutes of the CoC meeting held on 28.03.2016 is linked herewith).

We also finally took a call to go for judicial redressal on the disparity of the Recruitment Rules of Executive Assistant with that of CBDT.  I along with some Comrades of Delhi Unit will finalize the netegrity in due time and as early as possible.

I am sure that you will be keen to know on the developments to your career advancement.  But right now I don’t have the finished product for you on my way back from Delhi.  But we will take all practicable and possible steps.

Dear Comrades,

          As you are aware that most of the members of this Association are in great difficulty as most of the matters taken up with the Administration, are not being considered. We have taken up all the issues such as promotional issues. We have entered in the month of March and so far no DPC is decided by the Administrator. 

The executive body of this Association has take all necessary steps including discussion with competent authority and they are taking necessary clarification on various aspect on technical issue. 

The Board office has desired specific information from the Cadre Controlling Authorities to grant one time relaxation for the grade of Inspector (Click to See letter). 

We have been requesting the Authority for calculating the vacancies created for Chakan-da-bagh and Salamabad, in the state of J&K, way back in 2009 and which were left out in the DPC held on 21.11.2015. Also some posts created under Cost Recovery Basis in the Customs Commissionerate, Ludhiana, have not been taken care of. (Click to see letter). 

There is technical issue in calculating the eligibility criteria of service which is rendered in the grade of Sepoy. We are in touch with the authority and lets hope for the best (Click to see letter).

Rest, you know we are making efforts which is beyond our capacity. Will revert back soon, if any update is received

Dear Comrades,

          The Association is taking care of the points raised by the members under the points raised by you called for take up with the Principal Commissioner, Chandigarh-I (CCA).

          The points take up under JCM (See Letter) and Other points related to Ministerial Officer's  Agenda Points (See Letter). The JCM meeting was held with Principal Commissioner, Chandigarh-I on 14.01.2016 in a cordial environment and we took up and elaborated our points to them. The Minutes of the JCM meeting are yet to be received. However, we are perusing all the points raised by us with the Administration. 

          This Association took up the matter (through proper channel) with Member (P&V) which has been forwarded by the office of the Chief Commissioner (See Letter). Also we have taken up the matter with Administration to withheld the re-designation of EA so that the problem of promotion from TA to STA and STA to DOS / Inspector are not affected (See Letter). 

       We with full strength, facing the officers face to face by holding meeting with the Administration, are strongly taking up all the issues relating to promotions of all the cadres right from LDC to TA, TA to STA, STA to DOS / Inspector. We are hopeful of getting the due in due course.

          The promotion of CAO is also being looked after by us (National level Association) and a letter is received from Board Office vide letter dated 20.01.2016 (See Letter) and Annexure (See Letter) whereby some information is called from CCAs.

          As informed earlier, we have attended the Meeting at Ahemdabad and all the points which are of the main concerns of the cadres, have well been took up with National level and discussed the further course to be taken up which shall be followed as per instructions received from National level Association.

Dear Comrades,

           A general body meeting was held at Zonal headquarters, Chandigarh on 08.01.2016 to discuss the issue relating to the Ministerial Cadres. The points were called from all the Commissionerates and the main points highlighted by the members are taken in to consideration and the following action is taken:-

          Points taken up with the Principal Commissioner, Central Excise Commissionerate, Chandigarh-I for the proposed JCM meeting on 14.01.2016:-

(1) Posting of TAs in place other than the Administrative work such as in Tech, CAT & CERA seats.

(2) Joining process of TAs on provisional basis after receipt of Dossiers for CGL - 2014.

(3) Delay in issue of Confirmation orders.

(4) DPC Model Calendar not being followed:

          Points which do not cover under JCM but pertains to the other cadres of Ministerial Association, have also been taken up with the Principal Commissioner, Central Excise Commissionerate, Chandigarh-I alongwith the proposed JCM meeting on 14.01.2016:-

 

(1) Promotion for the post of Inspectors

(2) Promotion of other Cadres

(3) Internal rotaion of staff

(4) Disclosure of minutes of all DPCs on official website.

(5) Calculation of vacancies in a transparent manner:

(6) Timely updating and uploading of Seniority list and uploading on website.

 

          With respect to the progress of the ongoing matters at Board level, the following progress is monitored by the undersigned:-

 

(1) AO to CAO:-

 

          The identification of missing dossiers in the Board office are being traced and a list of such is being prepared. The dedicated members of the National Federation are working there for the sake of the welfare of the cadre. But it is found from the scrutiny of records that 15 Zones have not yer sent the desired report toBoard.

 

(2)  DOS to AO:-

 

         Zones are not serious about forwarding the requisite report and thus the matter could not be taken for consideration till the reports are received by Board.

(3)  STA to Inspector:-

 

           A letter is written to Board by National Federation on 07.01.2016 (See Copy) whereby we have urged the Board to clarify to all CCAs to go ahead for DPCs on the basis of already accepted terms by board itself vide its earlier letter stating that the Cadre Restructuring shall be taken into account on the day when the RRs for the post is notified. In this case the RRs of Inspectors have not yet notified so all the vacancies are of pre-cadre and lets see the outcome of this.

 

          With respect to the Relaxation, the file shall be discussed after the allocation of TAs / Inspectors are made by Board office.

(4)  TA to STA:-

 

          After the publication of RRs for the post of EA, it is very difficult to get the promotions, we are in the process of writing a letter to Board office. the letter has already been drafted and awaiting for approval by President (National level) and hope that the same shall be issued in this week. 

          We are urging the Protection clause in the RRs of EA as per DoPT's OM dated 31.12.2010 and I am hopefull that we shall get this. Matter is required to be pursued regularly at Baord level.

 

          With respect to Relaxation, the comments have been put in file and the file shall be put up within this week.

(5)  LDC to TA:-

 

          The comments called by Board are placed in the file and the file shall be put up shortly.

(6)   7th CPC:-

 

          No update as the comments are lying with Board office and till date not forwarded to Implementation cell.

        In view of above stated, I request all the members to kindly send your points of concern for taking up for discussion in the Common house meeting which is proposed in the next week. After discussion, the agenda points shall be finalized which are required to be discussed at National level.

Dear Comrades,

     After few hours, 2015 will be the history and we all will be busy in celebrating / welcoming the New Year 2016. Some historic moments of the year are briefed hereunder:-

Revamping of Association:-

     The Association was in existing for many years but was in a state of pathetic. The president retired on 31 December, 2014 and the General Secretary was about to retire on 30 April 2015 and it was not even in operation. However the Association has contributed a well maintained bank balance for us.

Need for revamping of Association:- 

     As the promotions for the post of STA and Inspectors were held up without any specific reason and there was no one to take up the matter with the authority for the affected cadres. It was decided by some specific active members to revamp the association.

The current body was elected by calling a special house at CR Building, Chandigarh on 16 April 2015 under the Chairmanship of Sh. Anil Kumar, the then General Secretary of the Association.

     As on date, we can proudly say that about 95% staff in the grades of AO, DOS, STA, TA and LDC are members enrolled this year with the Association. The only left over about 05% have not joined due to their personal grievances towards the past happening with the Association (i.e. on or before 16 April, 2015).

Targets:-

     The first and foremost  task of the Association formed was to take up the matter of halted promotions in the grade of STA and Inspectors. The body took all the steps to get this going through talks with authorities, taking up matter in writing and then at National level.

Achievements:- 

    As we informed the forming of the Association to the Federation, it was apprised by them that a convention was called in Hyderabad by National Federation on 16 May, 2015. The President of Federation made several calls and emphasised to attend this meeting. I attended the meeting and represented the Chandigarh Zone. There I was elected as Assistant Secretary General and thus the recognition of Chandigarh Zone was made at National level.

     Through the National Federation and being a member of the team, we made several visits to Senior officers of Board such as Chairman, Member (P&V) and others, Secretaries etc. with the agendas for the betterment of the cadres. It is fact that CBEC is too slow in taking decisions and the file moved from here to there for a simple decision took about 3 months {i.e. from 16 June, 2015, the first meeting with Member (P&V)}. Finally we got clarification on 17.09.2015 on the cadre of EA.

     The matter was not resolved by this too, but anyhow by making meeting with the authorities, we could finally got succeed.

Unachieved Targets:-

     Although the process is still going on for the various other targets set to get it in 2015 but could not get the same are:-

       (i)     Relaxation in RRs.

       (ii)    Promotions to the grade of CAO

      (iii)    Promotions from DOS to AO

      (iv)    Clarification for the Sepoy / Havaldars - counting of service rendered as Sepoy.

      (v)     Withdrawal of RRs for EA

      (vi)    Relaxation in education qualification for promotion to the grade of LDC & TA.

     To achieve these set goals, the Association is making efforts but the hurdles are at every step and we are working with full co-ordination and co-operation. We discuss each issue regularly and hope to get these done in coming months.

     With our sincere efforts, we took up the matters with the concerned authority and at appropriate level of all the grades which is of common nature without hampering the sentiments of others. 

Strength: 

     The present Association is infact the only Association which is active in this zone. We are strengthened enough at National and Zonal level. It is felt to strengthening the Association  at Commissionerate level to redress the problems at Commissionerate level. Therefore, it is urged to all the Unit level members to be united and fight for the rights.

     Finally, we are about to enter in the new year, we wish you a very Happy New Year

Letters whereby, the President is inviting for the Meeting at Ahemdabad:-

Comments forwarded for relaxation for STA and TA.

Dear Comrades,

In response to Board's circular dated 02.12.2015, vide which suggestions were sought on relaxation of the Recruitment Rules of STA & TA, we have also submitted our views (CLICK TO VIEW - STA-RELAXATION & TA-RELAXATION).

       The national body is also pursuing some relaxation in the pre-restructured Recruitment Rules and also demanding for scraping of the RR of EA in its present form.  Board vide it's communication dated 14.12.2015 (available in CBEC website click here to see)  has tried to defend the RR of EA which we will oppose properly with justification.

Further, a meeting of All India body is called on 23.01.2016 in Ahemdabad to discuss not only the burning issues but also to elect a new body as some of its members have promoted. The executive Committee shall take a call on on the agenda points to be raised in the meeting and the office bearers who will be attending the above meeting shortly.

GSR Notification of Recruitment Rules for the post of EA under CBEC

Dear Comrades,

Board has clarified vide letter dated 14.12.2015 (See Letter) whereby it has been clarified that how the direct EA proposal came into publication with RRs of EA.

We (the National Body) is in discussion and till date we have not accepted these RRs. We have issued letter dated 02.12.2015 whereby we have again requested for withdrawal of RRs for EA.

Further, we have issued letter to Chief Commissioner and Pr. Commissioner, Central Excise Zone, Chandigarh-I requesting them to initiate process for promotion to be effected from 01.04.2016. (See letter). With regards to the vacancies position in pre-cadre, the Association is in constant touch and looking into the matter.

Submission made before the 7th CPC - update regarding

Dear Comrades,

As you are aware that I have been nominated by the President, National Federation to represent the Federation under the capacity of Assistant Secretary General (Additional charge of Liaison Secretary) on his behalf in the meeting called by Board office on 14.12.2015 in connection with the 7th CPC.

The meeting was Chaired by Joint Secretary (Admn) and the submission from this Association / Federation was submitted to him (Click to See submission). The submission was also made in brief (Click to see) so that the main points can be focused.

Board has issued Minutes for the Meeting held vide letter dated 14.12.2015 (Check).

Further, all the files which are being pursued by us including relaxation files are moving on the right track. We may get a good news in new year i.e. in January, 2016.

A meeting invited by Board office on 14.12.2015 to discuss the 7th CPC repot

Dear Comrades,

The Board office vide letter dated 09th December 2015 invited a meeting of all the Associations under CBEC on 14th December 2015 at 11 AM in the office of Joint Secretary (Admn). The national Federation has nominated my name to attend the above meeting. You may recall the earlier submission by the National Federation on 31.07.2014 (Click to see copy) and 17.06.2015 (Click to see copy) which were not considered by 7th CPC.

The fresh submission by National Federation are being prepared and shortly shall be sent to Board office. A copy shall be provided after submission.

We hope that the pay parity of the officers be resolved.

              This association shall observe 27th November 2015, as 'Black Day', by wearing black badges by each members of this association, in office, during working hours, in order to protest the retrograde recommendations of the 7th Central Pay Commission. This is in support of the call given by the National Joint Council of Action (NJCA) (letter enclosed).

    All the office bearers of Local Unit leaders & all Members are requested to make necessary arrangements to make the programme a grand success. A notice in this regard has already been issued to the Chief Commissioner and the Commissioners. (Copy of Notice)

Promotion to the grade of CAO:

The Board vide letter dated 10th November 2015 whereby it has been decided to review the DPCs conducted in 2007-08, 2012-13 and 2013-14,  

Also the Board has updated the All India Seniority List of Administrative Officers. 

OM issued by DGHRD, New Delhi - correcting / amending AISL of Administrative Officers:

The DPCs conducted (03 in numbers) have to be reviewed first and then fresh DPC for CAO shall take place.
